本平台(以下簡稱「本平台」)是一個供汽車攝影愛好者交流藝術作品的平台。所有上傳的照片、連結及內容均由用戶(包括攝影師)自行提供及上載。

1. 本平台僅供藝術交流用途

本平台內容僅供個人藝術欣賞、攝影技巧交流之用,不構成任何交通資訊、路況提示、聚集召集或導航建議。用戶不得將本平台用於任何違反香港法律的活動,包括但不限於非法集結、阻礙交通或非法賽車。

2. 用戶自行負責

用戶同意自行承擔使用本平台的所有風險。本平台對用戶上傳內容的準確性、真實性、合法性不作任何明示或暗示的保證。用戶須確保其上傳的內容(包括照片、地點描述、Facebook 相簿連結)不違反香港《公安條例》、《道路交通條例》及其他適用法律。

3. 平台不承擔責任

在法律允許的最大範圍內,本平台及其營運者、員工、代理人對以下事項概不承擔任何責任(無論是合約、侵權、疏忽或其他):

本平台保留絕對權利(但無義務)審核、修改或移除任何內容,而無需事先通知或作出解釋。若發現內容涉嫌違法,本平台會配合執法機關提供相關資料。

5. 地圖顯示與通知

攝影師可自行選擇是否在地圖上顯示位置,及是否接受事後通知。本平台不保證任何位置資訊的準確性或即時性。用戶同意,所有位置相關功能均為自願使用,且不構成任何聚集或活動組織。

6. 不鼓勵任何違法行為

本平台明確不鼓勵、不提倡、亦不容許任何超速駕駛、非法賽車(街頭競速)、危險駕駛、非法集結、阻礙交通或任何違反香港法律的行為。本平台的一切功能(包括記錄行程、地圖顯示、車隊及通知)均不得用作組織、召集、協助或宣傳上述行為。用戶因進行或參與任何違法行為而引致的一切後果、意外、傷亡、損失、罰款、檢控或法律責任,概由該用戶自行承擔,本平台一概不負責。

用戶使用本平台即表示已閱讀、理解並同意本免責聲明。如不同意,請立即停止使用。

DISCLAIMER (English)

This platform (the "Platform") is a platform for automotive photography enthusiasts to exchange artistic works. All uploaded photos, links and content are provided and uploaded by users (including photographers) themselves.

1. For artistic exchange only

The content on the Platform is intended solely for personal artistic appreciation and the exchange of photography skills. It does not constitute any traffic information, road-condition alerts, calls to gather, or navigation advice. Users must not use the Platform for any activity that violates the laws of Hong Kong, including but not limited to unlawful assembly, obstruction of traffic, or illegal racing.

2. Users act at their own responsibility

Users agree to bear all risks of using the Platform. The Platform makes no express or implied warranty as to the accuracy, authenticity or legality of user-uploaded content. Users must ensure that their uploaded content (including photos, location descriptions and Facebook album links) does not violate the Public Order Ordinance, the Road Traffic Ordinance, or other applicable laws of Hong Kong.

To the maximum extent permitted by law, the Platform and its operators, employees and agents shall bear no liability whatsoever (whether in contract, tort, negligence or otherwise) for:

The Platform reserves the absolute right (but is under no obligation) to review, modify or remove any content, without prior notice or explanation. Where content is suspected to be unlawful, the Platform will cooperate with law-enforcement agencies by providing the relevant information.

5. Map display and notifications

Photographers may choose whether to display their location on the map and whether to accept after-the-fact notifications. The Platform does not guarantee the accuracy or timeliness of any location information. Users agree that all location-related features are used voluntarily and do not constitute any gathering or organisation of activities.

6. No encouragement of unlawful conduct

The Platform expressly does not encourage, promote or permit speeding, illegal racing (street racing), dangerous driving, unlawful assembly, obstruction of traffic, or any other conduct that violates the laws of Hong Kong. None of the Platform's features (including ride recording, map display, groups and notifications) may be used to organise, summon, assist or promote any such conduct. All consequences, accidents, injuries, losses, fines, prosecutions or legal liabilities arising from any unlawful conduct engaged in or participated in by a user are borne solely by that user, and the Platform accepts no responsibility whatsoever.

By using the Platform, you acknowledge that you have read, understood and agree to this Disclaimer. If you do not agree, please stop using the Platform immediately.
